Florida's Abortion Laws After the 2024 Election

In the 2024 election, a proposal to amend Florida's constitution to include abortion rights did not pass. As a result, the state’s existing abortion laws remain in effect. Understanding these laws is important for navigating your options and knowing what is required in Florida.

Here are the key aspects of Florida’s abortion laws as of 2024:

Six-Week Abortion Ban

Florida’s Heartbeat Protection Act prohibits abortions after six weeks of pregnancy, except in cases where the mother’s life is at risk or the fetus has a fatal abnormality. This law means that most abortions must be performed before a detectable heartbeat, which can be as early as six weeks.

Florida law mandates parental consent for anyone under the age of 18 seeking an abortion. A parent or legal guardian must provide written approval before the procedure, adding a step for minors.

24-Hour Waiting Period and In-Person Appointments

Florida law requires a mandatory 24-hour waiting period between a consultation and the abortion procedure. Patients must attend two separate in-person appointments:

  • The first appointment includes lab work, an ultrasound, educational resources, and a consultation with a physician.

  • The second appointment for the procedure must take place at least 24 hours after the initial visit.

No Telemedicine for Abortion Services

The state prohibits telemedicine for abortion services. Physicians must dispense medication for medical abortions in person, and abortion pills cannot be mailed or delivered. This policy requires women seeking medical abortions to visit a clinic in person.
